Julien’s Auctions Files Lawsuit Against Live Auctioneers Over Michael Jackson “Neverland” Auction for Breach of Contract and Negligence

Following last month’s development of a jury rejecting a lawsuit by collector Richard LaPointe over the canceled “Neverland” auction of Michael Jackson memorabilia, Julien’s Auction has now filed its own complaint against Live Auctioneers, the online bidding service provider for the event.  The new complaint, filed in Los Angeles County Superior Court, cites two causes of auction – breach of contract and negligence. Beverly Hills Courier Reports “Judge Rules In Favor of Julien’s Auction House” in Lawsuit Brought By Michael Jackson Memorabilia Collector Richard LaPointe

Today the Beverly Hills Courier published the latest breaking news about the ongoing legal action brought by collector Richard LaPointe against MJJ Productions, Julien’s Auctions, and others. According to the news story, the “jury today rejected a lawsuit in which a collector of celebrity memorabilia maintained that a Los Angeles auction house broke a contract to sell him 14 items that belonged to Michael Jackson“, following 30 minutes of deliberation.

Beverly Hills Courier Reports on Partial Settlement of Michael Jackson Memorabilia Lawsuit with Collector Richard LaPointe

Today the Beverly Hills Courier published an update on the ongoing legal action brought by collector Richard LaPointe against MJJ Productions, Julien’s Auctions, and others.  Per the article, Michael Jackson’s estate will sell LaPointe 64 of the 80+ items under dispute, which were pulled from public auction in 2009 when the entire sale was canceled following a settlement between MJJ Productions and Julien’s Auctions in their own legal dispute. Facebook Hosts Ongoing Public Debate Over Original Sculptor Credit for Star Wars Stormtrooper (Andrew Ainsworth or Liz Moore & Brian Muir)

Amid the topics of copyright ownership, enforcement of a U.S. judgment in the UK, determination of “works of art”, and other issues as featured in mainstream media reports about the ongoing legal battle between Lucasfilm LTD (LFL) and Andrew Ainsworth and his Shepperton Design Studios (SDS), what has not garnered as much focus is the debate over which artist originally sculpted the iconic stormtrooper helmet design that was adopted for use in Star Wars: A New Hope and the films that followed.  [Read more…]

Update on Collector Lawsuit Against Julien’s Auctions Over Canceled Michael Jackson Memorabilia Sale Event

As reported throughout 2009 and last updated over one year ago, efforts by Julien’s Auctions to offer for sale memorabilia owned by Michael Jackson were embroiled in controversy and legal action, which ultimately led to the cancellation of the event following a settlement between the auction house and MJJ Productions.  The pop star died just two months later. eBay Shill Bidder Ordered By Judge To Pay £5,000

As reported back in April (see New eBay Legal Development in the UK – Seller to be Fined up to £50,000 for Shill Bidding), an eBay seller in the UK, Paul Barrett, plead guilty to shill bidding his own auctions. Yesterday, the judge in the case ordered Barrett to pay £5,000 in fines and court costs and to do 250 hours of community service. [Read more…]

New eBay Legal Development in the UK – Seller to be Fined up to £50,000 for Shill Bidding

The latest in a series of interesting legal developments related to eBay in the past few years, breaking news today is the case of an eBay seller in the UK who faces up to £50,000 in fines for shill bidding his own auctions.  The Daily Mail reports this is the first case in which someone is being fined for such activities. AFP Report: Court Finds eBay “Guilty of Negligence” In Power Seller Fraud Case, Buyer Awarded $22,000

Per a report from the AFP, an Austrian court has found eBay to be guilty of negligence in a case about a buyer who used the auction site to purchase gold from an eBay “Power Seller” dealer, which he never received.  [Read more…]
